Senator Imee Marcos said the Philippines ''had no legal representation to arrest'' former President Rodrigo Duterte and turn him over to the International Criminal Court for his alleged crimes against humanity on March 11.

In her preliminary report released on Thursday, Marcos said '' what was issued was only a diffusion notice that was not verified or approved by the International Police Organization (Interpol) secretariat.''

She added ''there were glaring violations on the rights of FPRRD (former President Rodrigo Roa Duterte).''

But Marcos said she was not sure if there would be a second hearing of Committee on Foreign Relations.

"We are not certain if we will continue and if there will be a second hearing as we need to find credible witnesses ... If it will not push through we will just study the information revealed last week", Marcos added.

Last Monday, Senate President Francis Escudero confirmed receiving a letter from Executive Secretary Lucas Bersamin invoking executive privilege regarding the issue.

Palace Press Officer and Undersecretary Claire Castro downplayed the senator's report.

She added that even under the terms of the notice, which was not verified, ''there was no obligation on the part of the Philippines to turn over... Duterte to the ICC, absent any request for extradition or request for surrender.''

Marcos said there was ''no indication that the ICC even requested for the surrender of FPRRD after his provisional arrest.'' ''There is likewise no indication that the ICC requested extradiction after the arrest of FPRRD,'' he added.

The senator said the government decided to help the ICC to arrest Duterte and there were ''glaring violations'' on the rights of Duterte.

These were, Marcos said, '' the Constitutional safeguards guaranteeing liberty and due process of law were not observed. ''The Constitutional safeguards for the right to liberty of abode were not observed'' and Duterte '' was deprived of the right to be visited or have conferences with immediate members of his family.''
