The House of Representatives prosecution team will seek clarification from the Senate as an impeachment court which decided to remand the Articles of Impeachment of Vice President Sara Duterte back to the House.
In a press conference, Batangas Rep-elect Gerville Luistro, a member of the prosecution panel, stated they would file a motion for clarification on the impeachment court's orders on Tuesday night.
"The decision of the impeachment court yesterday is not clear on the side of the prosecution panel, thus, we resolved to seek the clarification of the impeachment court," Luistro said.
Luistro said the House is ''not defying the order (of the Senate).'' ''We are deferring the receipt (of the Senate order) until we have clarified the actions taken by the Senate last night,'' said Luistro.
A news report on Wednesday night said the House adopted the motion to defer acceptance of articles of impeachment until the Senate ''has responded to clarificatory queries raised by the panel of prosecutors relative to the remand of the subject articles.''
Deputy House Minority Leader and 4Ps Partylist Rep-elect Marcelino Libanan added: '' We do not understand why they will return it to us. What shall we do? That is one of the things we should be enlightened."
The Senate impeachment court wants to make sure that the filing of the impeachment court on February did not violate the one-year ban in presenting this. Three other articles of impeachment against Duterte were filed late year.
Luistro stated that the prosecution panel remains firm that their filing of the impeachment complaint complied with the 1987 Constitution.
"We complied fully and strictly with the requirements of the constitution," Luistro said. "We did not violate the one-year prohibition rule," she added. Kate Christian Ravelo/DMS
