The House of Representatives on Tuesday thinks that Vice President Sara Duterte's camp is looking for 'procedural loopholes' to possibly dismiss the impeachment cases against her, following her answer ad cautelam to the summons by the Senate impeachment court.
In a press conference, House prosecution panel spokesperson Antonio Bucoy said that the Vice President's answer ad cautelam focus on procedural issues of the impeachment complaint was a redirection from the factual allegations against her.
"It's an expected move. If you can't answer the factual allegations, you resort to procedure. You'll divert the talks, that's what happened here. They diverted the focus from factual allegations using procedural issues," Bucoy said.
On Tuesday night, Bucoy told The Big Story that on Wednesday the House prosecution panel will file a manifestation to question the entry of Duterte's defense counsel ad cautelam and to submit a certification to the Senate that it filed the impeachment complaint legally.
Bucoy said that the filing of Duterte's lawyers entry ad cautelam means they do not recognize the jurisdiction of the impeachment court,
The House was furnished a copy of Duterte's reply to the summons of the Senate impeachment court on Monday. The House has five days to answer Duterte's comments.
Bucoy also said that Duterte does not recognize the jurisdiction of the impeachment court, hence her submission of an ad cautelam answer.
"They continue to not recognize the jurisdiction of the impeachment court. This is not right, it's as if she filed an answer but she doesn't recognize the jurisdiction," Bucoy said.
Despite this, Bucoy said that the House prosecution team will continue to present evidence regarding the impeachment case and that there is no reason to dismiss the trial.
"Nonetheless, we'll continue presenting the evidence because it's important for the people to know the allegation... There is no justifiable reason to dismiss the impeachment complaint without a trial,' Bucoy added. Velle White/DMS
