House of Representatives asks SC to reverse its ruling on Duterte impeachment

The House of Representatives filed on Monday a motion for reconsideration before the Supreme Court to reverse its decision nullifying the impeachment proceeding against Vice President Sara Duterte.

Through the Office of the Solicitor General, the House filed the motion seeking the reversal of the 13-0 Supreme Court ruling last July 25, 2025.

On February 5, Duterte was impeached after 215 members of the House of Representatives from the 19th Congress filed a complaint.

The complaint was based on allegations of misuse of confidential funds, reported threats against ranking officials, and other violations of the Constitution.

In its motion for reconsideration, the House asked the Supreme Court to allow Congress to perform the duties the Constitution asks from its chamber - to initiate impeachment proceedings for the House and to try the same, for the Senate.

"The House asks this Honorable Court not to stand with a certain political faction or another, but to uphold the Constitution, which gives life to all the institutions of government, and with the people, who in turn, are the true sovereign and to whom all accountability, trust and power are owed," it stated.

"Wherefore, premises considered, Respondents respectfully pray that the Honorable Court reverse the immediately executory nature of its July 25, 2025 decision, and after due proceedings, reconsider the same and dismiss the petitions for lack of merit," the motion added.

On July 25, the Supreme Court en Bbanc, "declared the Articles of Impeachment against Vice President Sara Z. Duterte unconstitutional, noting that it is barred by the one-year rule under Article XI, Section 3(5) of the Constitution and that it violates the right to due process enshrined in the Bill of Rights."

"Therefore, the Senate could not acquire jurisdiction over the impeachment proceedings. However, the Court said it is not absolving Vice President Duterte from any of the charges against her. But any subsequent impeachment complaint may only be filed starting February 6, 2026," the highest court stated.

The case against Duterte stemmed from four impeachment complaints, "first three were filed before the House of Representatives by private individuals and different groups on December 2, 4, and 19, 2024."
